1. Acceptance of Terms

Welcome to CryptoWish ("Platform," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CryptoWish, operated from the Netherlands.

By accessing, browsing, or using CryptoWish, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Platform.

2. Description of Service

CryptoWish is a decentralized application (dApp) that provides a platform where:

• Creators

  can create profiles and wishlists to receive cryptocurrency donations

• Supporters

  can view creator profiles and send cryptocurrency directly to creators

IMPORTANT: CryptoWish is solely a platform for facilitating peer-to-peer connections. We do NOT:

• Process, execute, or control any cryptocurrency transactions

• Act as a payment processor, financial institution, or money transmitter

• Custody, hold, or have access to any user funds or cryptocurrency

• Serve as an intermediary or party to any transactions

• Provide any financial, investment, or tax advice

All cryptocurrency transactions occur directly between users on blockchain networks. CryptoWish simply provides the interface for users to connect their wallets and initiate peer-to-peer transfers.

3. Eligibility

To use CryptoWish, you must:

• Be at least 18 years of age

• Have the legal capacity to enter into binding contracts

• Not be prohibited from using the Platform under applicable laws

• Comply with all local laws regarding online conduct and cryptocurrency transactions

• Not be located in a jurisdiction where cryptocurrency transactions are prohibited

By using CryptoWish, you represent and warrant that you meet all eligibility requirements.

4. Account Registration and Security

4.1 Creator Accounts

To create a wishlist, you must register an account by providing:

• A valid email address

• A cryptocurrency wallet address

• A username

• Optional profile information (photo, social media links)

You agree to:

• Provide accurate, current, and complete information

• Maintain and promptly update your account information

• Keep your account credentials secure

• Be responsible for all activities under your account

• Notify us immediately of any unauthorized access

4.2 Wallet Security

You are solely responsible for:

• Maintaining the security of your cryptocurrency wallet and private keys

• All transactions initiated from your wallet

• Any loss of funds due to compromised wallet security

CryptoWish will NEVER ask for your private keys, recovery phrase, or password. Anyone claiming to be from CryptoWish requesting this information is a scammer.

5. Peer-to-Peer Transactions and Platform Limitations

5.1 No Control Over Transactions

CRITICAL UNDERSTANDING:

CryptoWish does NOT process, execute, facilitate, or control cryptocurrency transactions. All transactions are:

• Peer-to-peer

  between the sender's wallet and recipient's wallet

• Executed directly on blockchain networks

  (Ethereum, Bitcoin, Solana, etc.)

• Irreversible

  once confirmed on the blockchain

• Outside of CryptoWish's control or influence

We merely provide an interface that displays creator wallet addresses and allows users to connect their wallets via third-party providers (WalletConnect, MetaMask).

5.2 No Transaction Verification or KYC

CryptoWish does NOT and CANNOT:

• Verify the identity of wallet owners

• Perform Know Your Customer (KYC) or Anti-Money Laundering (AML) checks

• Confirm that funds will be used as represented

• Validate the legitimacy of any creator profile or wallet address

• Guarantee that creators are who they claim to be

• Reverse, cancel, or modify transactions after execution

• Recover lost or stolen cryptocurrency

• Provide refunds for any transactions

5.3 Transaction Hash Storage

We store only the transaction hash to provide users with transaction confirmation. This does not give us any control over, access to, or responsibility for the transaction itself.

6. Disclaimer of Liability for Fraud and Misrepresentation

6.1 No Liability for User Conduct

CryptoWish is NOT liable for:

• Fraudulent creator profiles or misrepresentation of identity

• Creators who misuse funds or fail to use funds as represented

• Impersonation of creators or theft of creator identities

• Scams, phishing attempts, or fraudulent activities by users

• Disputes between senders and recipients

• Loss of funds due to user error (wrong address, wrong network, etc.)

• Unauthorized access to user wallets or accounts

• Any illegal activities conducted by users through the Platform

6.2 No Vetting or Verification

CryptoWish does NOT:

• Vet, verify, or validate creator identities or claims

• Investigate or monitor user activities

• Guarantee the authenticity of any profile information

• Verify that creators will fulfill any implied or stated promises

• Endorse or recommend any creators

Users engage with creators entirely at their own risk.

6.3 User Responsibility

You acknowledge and agree that:

• You are solely responsible for conducting your own due diligence before sending cryptocurrency

• You bear all risks associated with transactions on the Platform

• CryptoWish has no duty to investigate, monitor, or verify user identities or conduct

• All transactions are final and cannot be reversed by CryptoWish

7. Blockchain and Cryptocurrency Risks

7.1 Inherent Risks

Cryptocurrency transactions carry inherent risks, including but not limited to:

• Irreversibility:

  Blockchain transactions cannot be undone

• Volatility:

  Cryptocurrency values can fluctuate significantly

• Network Fees:

  Gas fees vary and may be substantial

• Network Congestion:

  Transaction times may vary

• Lost Access:

  Lost private keys result in permanent loss of funds

• Smart Contract Risks:

  Vulnerabilities in blockchain protocols

• Regulatory Uncertainty:

  Changing legal landscape for cryptocurrency

By using CryptoWish, you acknowledge and accept all such risks.

7.2 No Guarantees

CryptoWish makes no guarantees regarding:

• Transaction success or speed

• Gas fee amounts

• Blockchain network reliability

• Cryptocurrency value retention

• Platform uptime or availability

8. Intellectual Property

8.1 Platform Content

All content on CryptoWish, including text, graphics, logos, design, and software, is owned by CryptoWish or its licensors and protected by intellectual property laws.

You may not:

• Copy, modify, or distribute Platform content without permission

• Use the CryptoWish name or branding without authorization

• Reverse engineer or attempt to extract source code

• Create derivative works based on the Platform

8.2 User Content

By uploading content (profile photos, wishlist items, descriptions), you:

• Retain ownership of your content

• Grant CryptoWish a worldwide, non-exclusive, royalty-free license to display, store, and transmit your content

• Represent that you have all necessary rights to the content

• Agree that your content does not violate any third-party rights

9. Prohibited Activities

You agree NOT to:

• Use the Platform for any illegal purposes

• Engage in fraudulent activities or misrepresentation

• Impersonate any person or entity

• Upload malicious code or attempt to compromise Platform security

• Harass, abuse, or harm other users

• Violate any applicable laws or regulations

• Use the Platform for money laundering or terrorist financing

• Create fake or misleading creator profiles

• Manipulate or interfere with Platform functionality

• Scrape or collect user data without permission

• Circumvent any security features

• Use automated systems (bots) without authorization

Violation of these prohibitions may result in account termination and legal action.

10. Third-Party Services

CryptoWish integrates with third-party services including:

• Wallet Providers

  (WalletConnect, MetaMask)

• Blockchain Networks

  (Ethereum, Bitcoin, Solana)

• Hosting Services

These services operate under their own terms and privacy policies. CryptoWish is not responsible for:

• The performance, security, or availability of third-party services

• Any issues arising from third-party service use

• Changes to third-party terms or functionality

• Data practices of third-party providers

11. Disclaimers and Limitation of Liability

11.1 "AS IS" Disclaimer

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose

• Warranties of non-infringement

• Warranties of accuracy, reliability, or completeness

• Warranties of uninterrupted or error-free service

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

CryptoWish, its directors, employees, and affiliates SHALL NOT BE LIABLE FOR:

• Any direct, indirect, incidental, consequential, or punitive damages

• Loss of profits, revenue, data, or cryptocurrency

• Damages resulting from user errors or negligence

• Damages from unauthorized access to accounts or wallets

• Damages from fraudulent activities by other users

• Damages from blockchain network issues or failures

• Damages from third-party service failures

• Any damages exceeding €100 (one hundred euros)

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability) and even if CryptoWish was advised of the possibility of such damages.

11.3 Jurisdictional Variations

Some jurisdictions do not allow certain warranty disclaimers or liability limitations. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless CryptoWish, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform

• Your violation of these Terms

• Your violation of any laws or third-party rights

• Any transactions you conduct through the Platform

• Content you upload or submit

• Your negligence or willful misconduct

13. Termination

13.1 Termination by You

You may stop using the Platform at any time. To delete your creator account, contact us at privacyofficer@cryptowish.link.

13.2 Termination by Us

We reserve the right to:

• Suspend or terminate your account at any time, with or without notice

• Remove any content that violates these Terms

• Modify or discontinue the Platform at any time

Reasons for termination may include:

• Violation of these Terms

• Fraudulent or illegal activities

• Harm to other users or the Platform

• Extended inactivity

• Legal or regulatory requirements

13.3 Effect of Termination

Upon termination:

• Your right to use the Platform ceases immediately

• Your account data may be deleted (subject to legal retention requirements)

• Provisions that should survive (liability limitations, indemnification) remain in effect

• You remain responsible for all activities prior to termination

NOTE: Termination does NOT affect any blockchain transactions already executed, as these are outside our control.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms or Platform use shall be subject to the exclusive jurisdiction of the courts in the Netherlands.

14.3 Informal Resolution

Before initiating any legal action, you agree to first attempt to resolve disputes informally by contacting us at privacyofficer@cryptowish.link.

14.4 No Class Actions

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CryptoWish regarding Platform use.

15.2 Modifications

We may modify these Terms at any time by:

• Posting updated Terms on the Platform

• Updating the "Last Updated" date

• Notifying registered users via email (where applicable)

Continued use of the Platform after modifications constitutes acceptance of updated Terms. If you disagree with modifications, you must stop using the Platform.

15.3 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

15.4 Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

15.5 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

15.6 Force Majeure

CryptoWish is not liable for delays or failures caused by circumstances beyond our reasonable control, including blockchain network issues, government actions, natural disasters, or technical failures.

15.7 Language

These Terms are provided in English. If translated, the English version prevails in case of conflicts.

✓ You understand CryptoWish cannot recover lost funds or reverse transactions
✓ You understand CryptoWish does not verify user identities or conduct KYC
✓ You are solely responsible for conducting due diligence before transactions
✓ You accept that CryptoWish has no liability for fraud or misrepresentation by users
✓ You are using the Platform at your own risk
